In case of Dattaram Sawant & Anr v. Vidarbha Konkan Gramin Bank The Bombay High Court has ruled that denying someone their right to leave encashment would be a breach of their constitutional rights because leave encashment is similar to salary. A Bench of Justices Nitin Jamdar and MM Sathaye observed that leave encashment like salary is akin to property and if an employee has chosen to accumulate his earned leave to his credit, then encashment becomes his right. “Leave encashment is akin to a salary, which is property. Depriving a person of his property without any valid statutory provision would violate Article 300A of the Constitution of India. Leave encashment paid on account of unutilized leave is not a bounty. If an employee has earned it and the employee has chosen to accumulate his earned leave to his credit, then encashment becomes his right,” the Court held. The Court was approached by two employees, Dattaram Sawant and Seema Sawant, seeking encashment of privilege leaves which was rejected by their employer, Vidarbha Konkan Gramin Bank. Both had worked with the bank for over 30 years before tendering their resignations. On 29 April 1947, the Constituent Assembly of India discussed an interim report on fundamental rights prepared by the Sub-Committee on Fundamental Rights, which was one of the five sub-committees appointed by the Advisory Committee on Fundamental Rights, Minorities and Tribal and Excluded Areas. The interim report was presented by Sardar Vallabhbhai Patel, chairman of the Advisory Committee. As Granville Austin remarked in his book ‘The Indian Constitution: Cornerstone of a Nation,’ the discussion on the report saw little disagreement on the principle of civil liberties, as “history had done much of the members’ work for them” (right from the Swaraj Bill of 1895 to the Sapru Report of 1945). However, one of the sharpest criticisms of the interim report was delivered by Somnath Lahiri, elected to the Constituent Assembly from Bengal. In a prescient tone, Lahiri remarked that the fundamental rights were framed “from a police constable’s point of view and not from the point of view of a free and fighting nation.” Most importantly, as part of his critique on provisions relating to seditious speech, emergency exception and executive power, Lahiri also highlighted the absence of any categorical protections for the freedom of the press. Being the only Communist member of the Constituent Assembly, Lahiri’s critique was also informed by personal experiences with state repression, including police searches of his house, seizure of his speeches, and arrests of his fellow leaders from the Communist Party of India, as the party emerged as a formidable challenge to both the colonial government and the domination of the Indian National Congress in India's political trajectory. On 24 January 1947, the Constituent Assembly of India passed a resolution to form an Advisory Committee to prepare a report on fundamental rights, minority rights and the administration of the Tribal and Excluded and Partially Excluded Areas. While moving the resolution, Govind Ballabh Pant, elected to the Assembly from United Province, delivered a fervent speech against prioritising the idea of community over the individual. In his book 'Justice, Democracy and State in India,' Amarnath Mohanty argues how this universalist conception of citizenship, wrapped in a liberal discourse and advocated by many members of the Assembly, also worked to delegitimise articulations of community-based discrimination by minority groups. Pant's diatribe provides a window to understand the linkages between liberal individualism and the project of a homogenous nation-state. ~ Kolkata Municipal Corporation and anr vs Bimal Kumar Shah and ors The Supreme Court on Thursday took a significant step to protect private property from arbitrary state takeover for a “public purpose”, holding that compulsory acquisition without following mandatory procedures followed by a grant of compensation to the owners will not make the accession constitutional. These sub-rights, as traced in the judgment, are: ◾The Right To Notice: duty of the State to inform the person that it intends to acquire his property. ◾The Right To Be Heard: the duty of the State to hear objections to the acquisition. ◾The Right To A Reasoned Decision: the duty of the State to inform the person of its decision to acquire. ◾The Duty To Acquire Only For Public Purpose: the duty of the State to demonstrate that the acquisition is for public purpose. ◾The Right Of Restitution Or Fair Compensation: the duty of the State to restitute and rehabilitate. ◾The Right To An Efficient And Expeditious Process: the duty of the State to conduct the process of acquisition efficiently and within the prescribed timelines of the proceedings. ◾The Right Of Conclusion: final conclusion of the proceedings leading to vesting.
