I decided not to appeal against the Refusal to Assess decision for Kittens' EHC Needs Assessment by the unlawful 'professionals' at @coventrycitycouncil ✨ It wasn't a decision I have made lightly. I am right - he meets the threshold of requirements and therefore DESERVES to be assessed as he is ENTITLED to be. But, despite a keen knowledge that I am right and they are yet again acting unlawfully in refusing to assess a boy who clearly has SEN and clearly requires support, I have decided not to appeal. Why? Largely because I am, somehow, okay with my "side of the story" not being heard; I am right, and everyone involved knows it - especially Coventry City Council - but I am okay with not being "the winner". Why? A few reasons...It is possible that all avenues aren't exhausted at school, and to further prove our point we are going to do that (or attempt it) to further drive home how wrong Coventry City Council are. School had promised to be fully on our side, and that's a reassuring line despite the shit I've felt recently. I feel like SENCo and I reached a level of understanding. And, reading the application made, I do realise that his 'worst days' are still not violent enough (how ridiculous is that?) to be inherently disruptive. But, also because I know it will all go amazingly wrong as he goes up to the less play-focused years from September, and when he fails as spectacularly as he probably will without the level of support he is entitled to, we will lay it out on their doorstep and make them eat their words. But please understand me, this isn't an easy decision or necessarily the right one. I do not wish for failure for my little boy. I do not WANT my son to fail. I do not want my son to suffer. And I do not want my son to experience any wrong doings he doesn't have to - and I am not going to stop pushing and hauling and fighting - I'm just... Gathering evidence? PROVING OUR POINT.
