After a group of Texas women sued for clarity on when the state's total abortion ban allows emergency exceptions, the Texas Supreme Court unanimously ruled Friday that the current law was clear enough and did not need further language on when a physician can perform a life-saving abortion. The State v. Zurawski case asked for clarification into the ban's exceptions and also requested a list of conditions or other parameters that could qualify one for an emergency, life-saving abortion. The case has bounced around state courts, most recently referring back to the Texas Medical Board, which issued its proposed language in March. The language fell short of providing solid parameters, and physicians and patients alike slammed the board in a public hearing earlier this month. Even anti-abortion advocates commented that emergency exceptions were necessary. Echoing the rhetoric of anti-abortion advocates, the Texas Supreme Court said the law already allowed room for life-saving exceptions and that physicians "could not be fined or disciplined" for performing an emergency abortion under reasonable medical judgment. The Texas Supreme Court went on to say that the health threat does not have to be "imminent" to warrant an abortion, and the patient does not have to wait for physical impairment first. The Court also mirrored Texas Medical Board language that said an abortion can be performed either if the patient is at risk of death or "serious physical impairment." Florida enacted a new law on May 1, 2024, that bans abortions after six weeks of pregnancy, with a few exceptions including documented rape, incest and to save the life of the mother. Florida joins the majority of Southern states that now have complete bans or highly restrictive abortion laws, enacted since the Supreme Court overturned the federal right to get an abortion in June 2022. Many of the restrictive laws ban abortion after a set number of weeks. Florida Republicans supporting the bill have labeled it a reasonable compromise between a full abortion ban and few abortion restrictions. Research shows that women on average find out they are pregnant at five and a half weeks. About 23 percent do not know until seven weeks of pregnancy or later. Florida’s six-week ban will make it much harder for anyone to get abortions there — and it will also affect people in neighboring states who want or need an abortion. In 2023, Florida was home to the closest abortion clinic for 6.4 million women living in the South. In 2023, about 7,700 women from other Southern states, where abortion is now largely banned, traveled to Florida to get abortions. The governor of Louisiana signed a bill today that adds two abortifacient medications, Mifepristone and Misoprostol, to the state’s list of controlled dangerous substances. Medical professionals have spoken out against the measure, saying the medications have critical uses outside of abortion care, including aiding in labor and delivery, treating miscarriage and preventing gastrointestinal ulcers. Abortion is banned in Louisiana with limited exceptions, similar to North Dakota’s abortion ban. The reality is that restricting access to medications such as these will do more harm than good by restricting access for individuals who need these medications for purposes other than to induce an abortion, when all uses have been proven to be safe and effective. The categorization of these medications as controlled substances limits providers from prescribing these medications and creates “the false perception that these are dangerous drugs that require additional regulation”. It’s about more than just abortion. On June 24th, 2022, the Supreme Court ruled on the landmark case Dobbs v. Jackson Women’s Health Organization. This ruling reversed its original decision on the 1973 case Roe v. Wade, as well as the 1992 case Planned Parenthood v. Casey, and overturned women’s established constitutional right to abortion . This opened the door for individual states to regulate any aspect of abortion no longer protected federally. Since this Supreme Court decision, the landscape of reproductive-related legislation has seen significant shifts across the country. Currently, only 21 states remain that uphold a woman’s right to reproductive freedom by protecting access to abortion. In addition to banning, and often criminalizing, access to abortion, there have been discussions on expanding these efforts toward additional restrictions - including access to long term contraceptive and permanent sterilization procedures, access to emergency contraception, access to reproductive health education, access to miscarriage management medication, and access to in-vitro fertilization procedures and fertility treatments. Democracy depends on equal rights for all people. Losing our right to reproductive choice and freedom of reproductive decision-making is about more than just access to abortion care. The attack on reproductive choice is a continuation of silencing marginalized individuals and perpetuating inequality. Florida Republicans are working overtime to relentlessly strip their constituents of their rights. Here's the catch: Early #pregnancy detection is tough. A new study has found that more than 1 in 5 people have periods so irregular they're unlikely to know they're pregnant until after six weeks.¹ Yet another study concluded that 1 in 3 people learn they're pregnant past six weeks ². The 6 week time frame of this ban is nothing but a false promise of "choice." Additionally, First-trimester screening, done between 11 and 13 weeks, detects genetic abnormalities in fetuses. Louisiana just added abortion and miscarriage treatment medications to their list of “dangerous controlled substances” — alongside depressants, steroids, and opioids. Under the new law, women who don’t perfectly comply with the rules around possessing the medications would face up to 5 years in prison and up to $10,000 in fines. Louisiana has already inspired several other states to consider similar bills. The new law ignores hundreds of doctors who wrote to the Louisiana legislature to argue that this will only reduce health outcomes for pregnant women in Louisiana, which already ranks last in the nation on health. Just in! The Society of Family Planning's newest #WeCount report found that 19% of U.S. abortions are provided via Telehealth. This report captures, for the first time, that nearly 8,000 people per month in states with bans or severe restrictions accessed medication abortion from clinicians providing via telehealth under shield law protections from October to December 2023. The report found between 87,600 and 92,640 abortions monthly between October-December 2023.
