The Delhi High Court emphasized the importance of gender neutrality in judicial proceedings, stating that courts must not be influenced by stereotypical views regarding gender or profession. This came as the court overturned an order clearing a police officer’s husband of cruelty charges under the Indian Penal Code.
Justice Swarana Kanta Sharma criticized the lower court’s decision, stating that it was not based on principles of criminal jurisprudence and fair trial but on unjustified biases, particularly the belief that a police officer cannot be a victim of domestic violence.
The court stressed that judges must adopt a gender-neutral mindset when crafting judgments, ensuring that their language and reasoning are free from gender-based prejudices. It called for gender sensitivity to be integrated into judicial education, urging the Delhi Judicial Academy to include it in its curriculum.
In the case at hand, both the husband and wife were employed by the Delhi Police, yet the lower court unfairly favored the husband based on his professional position while disregarding the wife’s complaints.
The court emphasized that professional achievements should enhance, not diminish, an individual’s standing, and noted that despite their success in the workplace, women can still face power imbalances and mistreatment in their personal lives.
The High Court asserted that women, regardless of their profession or background, deserve equal respect, recognition, and legal protection. It emphasized that gender equality benefits both men and women and called for a deeper understanding of diverse perspectives to ensure fair and informed judicial decisions, thereby strengthening public trust in the legal system.
