Thousands of New York City tenants gained a new legal right to challenge rent hikes, plus new protections from evictions in April under the state’s Good Cause eviction law. But finding out if you are protected by Good Cause is no simple task Good Cause eviction is essentially what it sounds like: Your landlord needs a good reason to evict you. If you’re covered, the law also gives you the right to challenge a rent increase of above 8.82 percent in court—and more bargaining power when negotiating a lease renewal. (So if your monthly rent is $3,000, you could fight a rent increase of more than $3,264.60). But Good Cause doesn’t apply to every market-rate tenant in NYC. Roughly 61,000 buildings are covered under the law, according to openigloo, an apartment listing and review platform. Brooklyn holds the largest number of protected buildings, at 22,319, followed by Manhattan, Queens, the Bronx, and Staten Island, according to openigloo data. One simple way to see if Good Cause applies to your unit is to search your address on the apartment listing and review platform openigloo, or you can do your own research to check if your building is covered. Many New York City market-rate tenants scored new protections from eviction and big rent hikes on Saturday, thanks to policies passed in the state budget. After years of debate, state legislators passed a Good Cause eviction law—which means a landlord must have a good reason to evict a market-rate tenant, and is required to justify raising a tenant’s rent by more than a certain threshold. (Previously, a landlord didn’t have to justify a rent increase or why they didn’t renew a market rate tenant’s lease). The hotly debated policy gives market-rate renters a legal way to challenge an “unreasonable” rent increase, defined as more than 10 percent, or 5 percent plus the consumer price index (a measure of inflation), whichever is lower. It’s a significant slate of new rights for NYC renters, though it’s difficult to tell which renters are protected given a handful of notable exemptions to the law. State lawmakers have reached “a conceptual agreement” on New York’s $237 billion budget, including additional eviction protections for market-rate renters and a new development tax credit, Governor Kathy Hochul announced Monday. Hochul’s announcement managed to disappoint both landlord and tenant advocates on two key issues: Good Cause eviction and the replacement of the 421-a tax incentive for affordable housing development. Hochul couched the plan as the “parameters of a conceptual agreement” in her announcement, and it’s still a little light on details. It also comes two weeks after the budget was due on April 1st. Both landlord and tenant groups slammed the deal. The tenant advocacy coalition Housing Justice for All claimed that carve-outs to Good Cause eviction would exclude millions of tenants from eviction protection. At the same time, the president of real estate trade association the Real Estate Board of New York said Good Cause poses "significant new risks for owners, developers and funders." Expenses have not gone up 40% but if the landlord can prove that his/her expenses have gone up then under #GoodCause they’ll be able to raise the rent as long as they can prove it. Thank you all! You’re AMAZING! #Save63Tiffany started out of desperation of losing the place we’ve called home for 30 years. It was a cry for help, a form of rebellion against an unjust system that we felt was failing us. That after 30 years of paying our rent on time, building up this area, that was NOT what it is now, into a beautiful vibrant community we were on the verge of being forced out to make way for wealthy tenants. In that desperation and feeling isolated & frankly weak we decided to empower ourselves and fight back, but fight with love. We felt maybe if enough people heard our screams, learned of our struggle we can get some help, some allies to fight alongside us. What we never expected was just how caring and supportive our neighbors from the community, our elected officials and the housing Justice community would be and to be frank it’s been humbling and overwhelming. I’ve always said I love my community in fact my exact saying has always been, “We’re blessed to live on the best block in the greatest neighborhood in the world!” but we were never sure if it loved us back, the way we loved it, but now I can say with confidence that the answer is a resounding YES! The way this community has rallied behind us is just amazing. Thank you all! John Leyva, tenant organizer at 63 Tiffany Place in Brooklyn NY. John has lived in the building for 29 years with his son, who is autistic. For 29 years, John has helped build a real community not just in his building, but in the entire neighborhood overall. Right now, John is facing eviction and his fellow tenants have been harassed because the Low Income Housing Tax Credit (LIHTC) agreement expired early last year. #Greedflation has been going on in the rental industry almost since its inception! Check this out! An excerpt from “The Tenant Movement in New York City, 1904-1984”. “In the spring of 1904, several hundred residents of the Lower East Side, New York’s immigrant Jewish quarter, took to the streets in protest against their landlords and refused to pay their monthly rent. Property owners in the area, taking advantage of a decided shortage in rental housing, had recently increased tenement house rents by an additional 20 to 30 percent. But area residents, largely seasonal garment trade workers and small businessmen, could hardly afford the existing rent, which swallowed anywhere from one-quarter to one-third of their income, let alone an increment. “What is to become of the family whose sole breadwinner earns 60¢ a day and whose rent has been increased from $8.50 to $13 a month,” wondered one resident. Still another related that many Lower East Siders felt they “lived and worked for the landlord.”” This is nothing new and in fact has just gotten worse. While at that time rents were consuming “anywhere from one-quarter to one-third of their income” now studies say many New Yorkers are paying over half of their income in rent, often in these same old buildings that they were living in then! This has to stop! We cannot, we must not, allow the landlords to continue to abuse tenants this way! Support #GoodCauseEviction now! I have a lot of respect for @citylimitsnews & @eawhit but please, please, please, for the love of God stop feeding into this false narrative & using the worst case scenario pictures! 😡 This photo is NOT representative of what’s really going on & just feeds into the Real Estate Lobby’s propaganda. I invite you to come to my building #Save63Tiffany & take a look at the beautiful 5-6 apartments currently being warehoused, some for over 5 years, thats more representative of reality! And to make it more egregious under the #LIHTC agreement they, by law, were suppose to rent these apartments. There’s 5-6 families right now sitting in a shelter because of greed, plain & simple 😤. They’re warehousing apartments simply to make a point & hoping to pass their bill to circumvent Rent Stabilization laws, that’s the reality. But please let me also address that particular picture. So you mean to tell me that someone just moved out of that apartment? Why or how did that apartment get to that level of disrepair??? You mean that landlord had someone living under those conditions??? My point is that any apartment in that condition is the result of years of disrepair and neglect. It’s disgusting that any landlord forced a tenant to live under those conditions. Why was the previous tenant subjected to live like this? Isn’t that a better question to ask??? We all know #RentIsTooDamnHigh but why? #GreedFlation! Because #Landlords have been allowed to raise rents indiscriminately & there’s no logical or financial reason. If the expenses of running the buildings really has gone up so much that the rent raise is justified this bill will allow the landlord to prove that in court. But they DON’T WANT THAT BECAUSE THEY CAN’T, it’s #greed at its worst & it’s effecting the whole #NY economy. Lifelong #NYers are being priced out and having to leave their homes. Younger generations can’t afford to move out of their parent’s homes, can’t pay for housing & student loans, financially crippled. Residents have less discretional income which affects their spending and the industries that depends on that money. Too many NYers are rent burdened paying 50% or more of their income on housing. #GoodCause is an extremely well thought out bill that won’t affect the small landlords, that generally do right by their tenants. And has been proven in other states, like our neighbors in #NJ, that it will not affect the building of new housing. It’s time that #NYS join other states around the country that have adopted #GoodCause and reap the benefits of it. #GoodCauseEviction protects tenants from unreasonable #rent hikes and retaliatory or discriminatory #evictions. Currently, when a lease expires for most #apartments or #homes in #NY, the #landlord can choose not to renew it for any reason and raise the rent as high as they want. As a result, #landlords can kick out #tenants even for patently unfair reasons - like retaliation for raising concerns about living conditions - and spike the rent. There have been growing reports of rent hikes as high as 30, 50, even 100 %. For many #WorkingFamilies, that kind of increase all but amounts to an #eviction. #GoodCause can help families stay in their homes, fight unfair rent increases and evictions, and keep our neighborhoods stable and safe. #NYS needs this commonsense, basic #TenantProtection! We call on @govkathyhochul to stand on side of the #WorkingClass & pass #GOODCAUSE. This would not only #Save63Tiffany but all tenants in this state! 💪

The whole “affordable” housing lottery system is already a joke and only getting worse. Income requirements are as high $300k! Using AMI for eligibility is classist & racist & further promotes gentrification. It totally excludes those who need it most, namely the elderly & others on fixed income. This new policy of excluding members of the community, where the housing is being built, will just further those policies & lead to more gentrification of our neighborhoods. 🤬 But all this is by design. This is so ridiculous! People are being #displaced through no fault of their own, torn from communities they helped build & now you can’t even give them the largely false hope (because there were so little available units available anyway it really didn’t matter) but just the principle that they would try to sell it as helping “to fight segregation”!!! 🤬. The audacity!!! What a crock of 💩! I guess we’re seeing the results of all the judges #Trump put in, because that’s the only explanation for such a misguided decision. If they really want to make it more equitable & benefit the most in need they should stop using AMI (Average Median Income) as the determining factor! That causes more segregation than this! I’ll use our issue at #Save63Tiffany as an example, we live in a 70 unit building. Most of us have lived here 30 years, since the building opened in 1994. The building’s #LIHTC agreement is expiring & now they will try to “displace” us so wealthier people, who can pay 3-4X what we’re paying can move in. We’re fighting & it’s an uphill battle. After living here for 30 years we’ve built a community here & love this area. This is all all my severely nonverbal autistic 15 year old son knows. If, or when, we get “displaced” (I hate that word it’s such a pretty word for evicted & homeless but I digress) it would be nice to be able to get an opportunity to continue living in the community we helped build. On the city’s Housing Connect it’s only be a small percentage of the overall units anyway. Btw, have you checked Housing Connect lately? Some of the apartments’ income eligibility goes up to as high as $300k a year! AMI is wrong & creates more segregation! It’s ridiculous. This ruling is so wrong!
