This decision, delivered by Justice Sophy Thomas, involves the setting aside of the conviction and sentence of a man and his brother who were found guilty of offenses under Section 498A and Section 306 (abetment of suicide) of the IPC, over 20 years ago. The case pertained to the suicide of the man's live-in partner, who took her own life by self-immolation in 1997, allegedly due to harassment by the man's parents. The High Court determined that the couple's relationship was based on a non-legally binding agreement, and therefore, they were considered to be in a live-in relationship rather than being husband and wife, as required by Section 498A.
